Gujarat High Court notice to Adani, State & Central Govts

The Gujarat High Court on Thursday issued notices to Adani Power Ltd and the central and state governments for encroaching on a land in Bita, Abhdasa, Kutch and filling up a lake there. The court has directed the local collector to investigate the matter and file a report on December 8, 2011.

Bhimji Vador and Mohammed Hanif Padihar, residents of Bita, have moved a petition before the Gujarat high court through their advocate Hashim Qureshi, alleging that the company is in the process of developing a solar power project and has been encroaching the land reserved for the purpose of forestation under various schemes of the central and state governments.

The petition further alleges that the encroachment has affected implementation of various state and central schemes. Further, the gram panchayat has made several resolutions and complaints to various authorities including the chief minister. There was no action in this regard, because of which the villagers have moved the Gujarat High Court. 

The villagers have prayed to the court to direct the company to remove the encroachment from the land and restore the condition of Kakwada Lake. The petitioners have asked the company to provide employment to the villagers whose land had been acquired or give them suitable relief.

The division bench of acting Chief Justice Bhaskar Bhattacharya and Justice JB Pardiwala admitted the petition and issued notices to the development commissioner, Special Economic Zone, state revenue department, district collector of Kutch, officials of Adani Power Ltd and the chairman of the Special Economic Zone. Further, the court has directed the collector to investigate the issue and submit the report by December 8.
